His Highness Sheikh Mohammed bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE, may God protect him, in his capacity as Ruler of the Emirate of Dubai, issued Law No. 13 of 2020 regulating expert work before the judicial authorities in the Emirate of Dubai, with the aim of regulating these works and supporting judicial authorities with experts Legally and technically qualified, which contributes to the accuracy of judicial rulings and decisions issued by them, achieving prompt justice, enhancing the role of experts in achieving justice, and increasing the efficiency of practitioners of expertise for the purposes of accelerating litigation procedures, in addition to building and enabling national expertise to practice expert work.
The law stipulates that a table for the registration of experts shall be established in Dubai Courts, the form of which is determined, and the data and documents to be included in it, by a decision of the Director of Dubai Courts. The renewal request shall be submitted to the organizational unit concerned with expert affairs in Dubai Courts at least 30 days before its expiry date, and the registration shall be renewed in accordance with the conditions and procedures specified in this regard. Expert Affairs Committee.
The law also stipulated the formation of a committee in the Dubai Courts called the “Expert Affairs Committee”, whose system of work, the mechanism for holding its meetings, and how to take its decisions, are determined by a decision issued by His Highness the President of the Judicial Council. and the private sector, provided that the committee’s chairman and deputy are from among the members of the judiciary. The law detailed the functions of the Expert Affairs Committee.
In accordance with Law No. 13 of 2020, an organizational unit concerned with expert affairs is established in Dubai Courts, within its administrative organizational structure, which undertakes a set of tasks, the most important of which is conducting the process of registering experts in the list and determining the category of their classification in it, in accordance with the decisions issued by the Expert Affairs Committee in this regard. , preparing the charter and presenting it to the committee for approval, before submitting it to the Director of Dubai Courts for approval, supervising, controlling and inspecting the work of experts, evaluating them technically and submitting the necessary recommendations in this regard to the Expert Affairs Committee.
The organizational unit also refers the violations committed by the experts and the complaints submitted against them to the committee, reinforced by its recommendations regarding them.
The law defines the obligations and duties of the expert assigned by the judicial authority while conducting the work of the expert, as well as the duties of the parties to the dispute before the competent court.
The law included the technical evaluation mechanism for the expert and obligated the organizational unit to provide the expert with a copy of the technical evaluation report, within 15 days from the date of its issuance. The Experts Affairs Committee shall issue its decision on the grievance within 30 days from the date of submitting the grievance to it, and the decision shall be final.
In cases other than those stipulated in this law and the decisions issued pursuant thereto, the federal and local legislation in force in the Emirate of Dubai, including Federal Law No. 7 of 2012 regulating the expert profession before judicial authorities and its executive regulations, shall apply to the expert. The Director of Dubai Courts shall issue the decisions necessary to implement the provisions of this law, and they shall be published in the Official Gazette. And all persons registered in the roll at the time of the enforcement of this law will have to reconcile their conditions in accordance with its provisions upon the expiry of the period of their registration in the expert registration roll or the lapse of one year from the date of enforcement of this law, whichever is earlier. similar.
Any provision in any other legislation shall be repealed to the extent that it contradicts the provisions of Law No. 13 of 2020, and this law shall be published in the Official Gazette, and shall be enforced from the date of its publication.
