International Arbitration
- Arbitration is an increasingly chosen method of resolving civil and commercial disputes within the UAE or abroad, and the business community in the UAE consists of companies that prefer the flexible and experienced approach adopted by arbitration. - Arbitration is used to settle various disputes and disagreements in the United Arab Emirates. Arbitration is of three types: In binding arbitration, the two parties appoint an independent arbitrator so that the parties to the dispute are bound by the final decision. Non-binding arbitration means that each party retains its right to litigation in the courts if the arbitration decision is not accepted. In compulsory arbitration, the judge appoints an arbitrator at a time Early in the litigation process and in the event that the disputed amount is very small, which does not require long-term litigation procedures.
- Due to the position of the United Arab Emirates as a global commercial center, arbitration has become the best way to resolve commercial disputes, and many foreign investors prefer to refer their disputes to arbitration committees for various reasons, including avoiding lengthy procedures to resolve commercial disputes through subject courts and controversial international laws, in order to save time and money. And the effort, in addition to the fact that the UAE does not operate with the principle of judicial precedent, common in English common law, which makes the outcome of the dispute completely uncertain, given that the court procedures are written in Arabic. This raises difficulty for investors from non-Arab communities, and the decision of the arbitration committee can be approved and implemented after being approved by the concerned court.
